Commission Terms of Service
In order to file a commission you must agree to all of the following terms and conditions as listed on this page.Turn-around times for commissions may take anywhere from 2-6 weeks depending on complexity and life circumstances.Filing a Commission
♢ Business will be conducted through email with [email protected]. Please include the text CMSN in the subject line, or your message may be lost.♢ Any transactions will be handled through PayPal. Prices are non-negotiable.♢ Payment is due once details of the commissioned work have been made clear and agreed upon by Pikethorne (Madelyn Plum Machado) and the Commissioner.♢ Upon filing a commission; Pikethorne agrees to commit to presenting progress in the form of pre-defined deliverables.♢ Pikethorne retains the right to decline any commissions requesting the following:
- Material which the commissioner does not hold the rights to, or does not have permission to use.
- Material that is deemed overly fetishistic to an uncomfortable degree by Pikethorne
- Material that promotes hate-speech against real-world minority groups
- Material depicting violent sexual acts
- Material that would be otherwise illegal for Pikethorne to produce in the United States and Florida
- Pikethorne retains the right to deny a commission for any reason that may not be explicitly covered above.Deliverables
♢ For traditional works and digital paintings, deliverables from Pikethorne will include the following, in order, where applicable: Initial Sketch, Cleanup, Inking, Finished Product.♢ For pixel art, deliverables will include the following: Initial Sketch, Color Blocking, Finished Product.♢ The purpose of deliverables is to provide the context/direction for the succeeding deliverable. The commissioner is able to request 3 revisions to the initial sketch and cleanup deliverables.♢ The commissioner understands that once the final sketch and cleanup are approved, the final piece will be created using the sketch as a foundation. The commissioner may not make any requests that would contradict what is depicted in the initial sketch.Distribution Rights
♢ Pikethorne retains the right to control over commission prices and terms of service. Once a commission is paid for, it is adherent to the Terms outlined at the time of payment.♢ The commissioner must ensure that they have the rights to any characters, copyrighted, or trademarked material commissioned. Otherwise, the commissioner ensures that they have received permission from the original owner of any copyrighted content.♢ Pikethorne retains the exclusive right to the completed commissioned piece for the purposes of selling merchandise including but not limited to:_ poster prints, card sleeves, etc._♢ The commissioner is free to make prints of the provided piece for personal non-commercial use.♢ The commissioner may elect to negotiate with Pikethorne any terms to acquire commercial distribution rights to the finished piece. Pikethorne reserves the right to reject any negotiation offer.♢ The commissioner may not under any circumstances, repost or share the finished piece with any signatures or handles referencing Pikethorne removed from the original piece.Refunds and Cancellations
♢ The commissioner may request a cancellation at any point. Upon cancellation, a refund may be provided given current state of the piece.♢ If the commissioner requests a refund before any work has begun on the commissioned piece, they receive a full refund.♢ If the commissioner requests a cancellation before or in response to the initial sketch, the commissioner will receive a 95% refund.♢ After the initial sketch is approved, any cancellation before the delivery of the cleanup will allow the commissioner a 50% refund.♢ If the commissioner requests a cancellation at any point after cleanup, no refund will be provided.♢ Pikethorne reserves the right to cancel work on any commissioned piece for any reason. If Pikethorne issues a cancellation, a 95% refund will be issued.♢ Pikethorne holds the distribution rights to the art as described above, including for cancelled works, and may repurpose the sketch for a cancelled piece to create a different work without the copyrighted material owned by the commissioner.
